Please read these Terms of Service carefully before using DistroPack. By accessing or using our service, you agree to be bound by these terms.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and DistroPack ("we", "us", "our", or "DistroPack") governing your access to and use of the DistroPack platform, including our website, APIs, and related services (collectively, the "Service").

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

2. Description of Service

DistroPack is a Software-as-a-Service (SaaS) platform that enables developers to automate the creation, management, and distribution of Linux software packages. Our Service includes:

  • Automated package building for multiple Linux distributions (Debian/Ubuntu .deb, Fedora/RHEL .rpm, Arch Linux .pkg.tar.xz)
  • Repository hosting and management with proper metadata generation
  • GPG cryptographic signing of packages and repositories
  • Multi-architecture support (x86, x64, ARM, ARM64)
  • Build job queuing and status tracking
  • File storage and management for source files

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, at our sole discretion.

3. User Accounts and Registration

3.1 Account Creation

To use the Service, you must create an account by providing accurate, current, and complete information. You may register using email and password, or through third-party authentication providers (Google, GitHub) as available.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Use a strong, unique password
  • Notify us immediately of any unauthorized access or security breach
  • Ensure that your account information remains accurate and up-to-date
  • Not share your account credentials with third parties

3.3 Account Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Subscription Plans and Billing

4.1 Subscription Tiers

DistroPack offers multiple subscription tiers with varying features and limits:

  • Free Tier: 1 project, 1 package per project, Linux only, 10 builds per month per package, up to 100 MB packages
  • Developer Tier: 2 projects, 3 packages per project, Linux/Windows/macOS, 30 builds per month per package, up to 200 MB packages
  • Team Tier: 5 projects, 3 packages per project, Linux/Windows/macOS, 50 builds per month per package, up to 500 MB packages
  • Business Tier: 8 projects, 6 packages per project, Linux/Windows/macOS, 100 builds per month per package, up to 2 GB packages

4.2 Payment Processing

Paid subscriptions are processed through Paddle, our third-party payment processor. By subscribing to a paid tier, you agree to:

  • Provide accurate billing information
  • Authorize Paddle to charge your payment method
  • Pay all fees associated with your subscription tier
  • Comply with Paddle's terms of service and privacy policy

4.3 Billing and Renewal

Subscriptions are billed on a monthly basis and automatically renew unless cancelled. You may cancel your subscription at any time through your account settings or by contacting support. Cancellation will take effect at the end of your current billing period.

4.4 Usage Limits

Each subscription tier has specific limits on projects, packages, build counts, and file sizes. Exceeding these limits may result in service restrictions or require upgrading to a higher tier. Build limits reset monthly on your billing anniversary date.

5. User Content and Intellectual Property

5.1 Your Content

You retain all ownership rights to the content you upload, create, or provide to the Service ("User Content"), including source files, package configurations, and scripts. By using the Service, you grant DistroPack a limited, non-exclusive, worldwide, royalty-free license to:

  • Store, process, and transmit your User Content as necessary to provide the Service
  • Build packages from your source files
  • Host and distribute built packages through our repository infrastructure
  • Generate and maintain repository metadata

5.2 Your Responsibilities

You are solely responsible for your User Content and warrant that:

  • You own or have the necessary rights and licenses to use and distribute your User Content
  • Your User Content does not infringe upon the intellectual property rights of any third party
  • Your User Content complies with all applicable laws and regulations
  • Your User Content does not contain malicious code, viruses, or harmful components

5.3 DistroPack Intellectual Property

The Service, including its software, design, logos, trademarks, and documentation, is owned by DistroPack and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

6. Prohibited Uses

You agree not to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights
  • Upload, distribute, or create packages containing malware, spyware, or other harmful software
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Interfere with or disrupt the Service or servers connected to the Service
  • Attempt to gain unauthorized access to any portion of the Service or other accounts
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Circumvent or attempt to circumvent usage limits or subscription restrictions
  • Distribute packages that violate software licenses or intellectual property rights
  • Use the Service to build or distribute illegal, harmful, or offensive content

Violation of these prohibitions may result in immediate termination of your account and legal action.

7. Service Availability and Modifications

7.1 Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control.

7.2 Service Modifications

We reserve the right to modify, update, or discontinue features of the Service at any time. We will provide reasonable notice of significant changes when possible, but are not obligated to do so. Continued use of the Service after modifications constitutes acceptance of the changes.

8. Data Storage and Retention

Your User Content is stored securely using S3-compatible object storage. You may delete your projects, packages, and files at any time through the Service interface. Upon deletion:

  • Source files are removed from storage
  • Built packages are removed from repositories
  • Repository metadata is updated accordingly

We may retain certain data as required by law or for legitimate business purposes, such as billing records and security logs. See our Privacy Policy for more information on data retention.

9. Termination

9.1 Termination by You

You may terminate your account at any time by deleting your account through the Service interface or by contacting support. Upon termination:

  • Your access to the Service will be immediately revoked
  • Your User Content will be deleted in accordance with our data retention policies
  • Any active subscriptions will be cancelled
  • You will not be entitled to any refund for unused portions of your subscription (see our Refund Policy for details on refund eligibility)

9.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if you violate these Terms, engage in fraudulent or illegal activity, or for any other reason at our sole discretion. We are not liable for any damages resulting from such termination.

10. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT
  • WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR QUALITY OF THE SERVICE

We do not warrant that packages built through the Service will function correctly on all systems or that repository configurations will be compatible with all package managers. You are responsible for testing and validating your packages.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DISTROPACK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES
  • DAMAGES RESULTING FROM SERVICE INTERRUPTIONS OR FAILURES
  • DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT OR DATA
  • DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless DistroPack, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. For users located in Catalunya, the laws of Catalunya shall also apply where applicable.

13.2 Dispute Resolution Process

Before filing any formal legal proceeding, you agree to first contact us to attempt to resolve the dispute informally. If we cannot resolve the dispute within sixty (60) days, you agree that any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of Barcelona, Spain. Alternatively, disputes may be resolved through binding arbitration in accordance with the rules of the Court of Arbitration of Barcelona, except that you may bring claims in the competent small claims court if your claims qualify.

13.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

14. Third-Party Services

The Service integrates with third-party services, including:

  • Paddle: Payment processing and subscription management
  • S3-Compatible Storage: File storage and hosting
  • OAuth Providers: Google and GitHub for authentication

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or policies of these third parties.

15. Export Control and Compliance

You agree to comply with all applicable export control laws and regulations. You may not use the Service to export, re-export, or transfer software or technology in violation of any export control laws, including those of the United States and other applicable jurisdictions.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on this page
  • Updating the "Last Updated" date
  • Sending an email notification to your registered email address (for significant changes)

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service and terminate your account.

17. Miscellaneous

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DistroPack regarding the Service and supersede all prior agreements and understandings.

17.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

17.3 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

17.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
